Under UK law they are in breach of Human Rights (right to privacy ... disclosure of private facts). Lacking are prosecutions. But when they do start to flow one would hope parent companies (actions by subsidiaries) would be accounted in the penalties.

I believe that ssh private keys are protected by a passphrase...although that could be brute forced by a rouge process on your computer. More usually your .ssh folder content would just be copied to a attackers system from where they'd use their own kit to crack the ssh keys password that then open...

In many distros, an unprivileged user has all of the powers that root has, using sudo. To become root, you (or anyone who has broken into the system) can become root just by typing "sudo su" I think you'll find that is wrong, unless poorly reconfigured to do so. If that were the case then...
